MTS India files curative plea in Apex Court & Loop Telecom too sends notice to Indian Government

Sistema Shyam TeleServices Limited, the parent company of the MTS in India, has filed curative plea to set aside the Supreme Court order cancelling its license in 21 circle. This move comes after the Supreme Court rejected the Review Petition filed by all the aggrieved parties in the 2G license cancelling verdict announced in February.

Being a CDMA operator, MTS India (SSTL) believes that their case in different from all other parties as there were no finding or suggestion by the CAG report that CDMA spectrum was equally or anywhere near in demand as GSM back in 2008.

The other affected Telecom Operator that has announced its exit from National telecom space invoked the Investment Protection Treaty. Loop Telecom’s Mauritius based investors Capital Global and Kaif Investment has send notice to the Indian Government invoking the India-Mauritius Bilateral Investment Treaty.

Loop Telecom now joins MTS (SSTL) & Uninor (Telenor) that have already invoked such treaties. Vodafone too has invoked Investment Protection Treaty but not in 2G License Cancellation but over retrospective tax legislation.
